For manslaughter (CC 236), the Criminal Code currently allows up to life imprisonment, with no mandatory minimum. Life is drawn at 25 years for scale. Read the section.

Rais Muksal Usman pleaded guilty to manslaughter for his part in a planned 2023 home invasion in Burnaby to steal firearms, during which another intruder fatally stabbed the victim. Mr. Usman carried a knife but did not enter the bedroom where the stabbing happened. The Crown and defence jointly proposed six years in custody, and Justice Majawa accepted the joint submission, imposing six years less 885 days of credit for pre-sentence custody.

The sentence that the Crown and defence jointly submit is consistent with sentences in these roughly comparable cases. Having regard to these authorities, the principles regarding joint submissions discussed in Anthony-Cook, the aggravating and mitigating circumstances, and the considerations set out in Stone, I will accept the joint submission.
