For overcoming resistance to commission of offence (attempting to choke, suffocate or strangle) (CC 246(a)), the Criminal Code currently allows up to life imprisonment, with no mandatory minimum. Life is drawn at 25 years for scale. Read the section.

The offender was convicted after trial of sexual assault, uttering a threat to cause bodily harm, and attempting to choke the complainant to enable a sexual assault; an assault count was stayed. The Crown sought four years of imprisonment and the defence agreed. Justice Coughlan imposed four years in a federal institution, with concurrent sentences on the other counts, noting the sentence was increased to reflect the choking.
